Throughout these Terms, "Bonechoir", "we", "us", and "our" refer to VALKYRIE MARKETING SRL.
By accessing our Website, placing an order, creating an account, or otherwise using our services, you agree to these Terms.
If you do not agree with these Terms, you should not use the Website.
Nothing in these Terms limits or excludes any mandatory consumer rights that apply to you under the laws of your country of residence.
1. ABOUT BONECHOIR
Bonechoir is an independent apparel and artwork brand offering products including, but not limited to:
- T-shirts;
- hoodies;
- sweatshirts;
- stickers;
- sticker sheets and packs;
- accessories;
- limited-edition products;
- collection and Drop merchandise; and
- other products introduced from time to time.
Certain Bonechoir products are manufactured or printed after an order is placed.
We may use third-party manufacturing, printing, fulfillment, warehousing, payment, and delivery providers to produce and deliver customer orders.
These providers may operate from different countries or fulfillment locations.
2. ELIGIBILITY TO PURCHASE
By placing an order through the Website, you confirm that:
- you are legally capable of entering into a binding contract;
- you are at least the minimum legal age required to make the purchase in your jurisdiction, or have the permission of a parent or legal guardian;
- the information you provide is true, complete, and accurate; and
- you are purchasing products for lawful purposes.
We reserve the right to refuse or cancel an order where we reasonably believe that it involves fraud, payment misuse, unauthorized resale, abuse of our services, or unlawful activity.
3. PRODUCTS
We make reasonable efforts to display and describe our products accurately.
However, differences may occur between how a product appears on a screen and how the physical product appears in person.
These differences may include variations in:
- color;
- print positioning;
- print size;
- garment dimensions;
- fabric texture;
- garment dye;
- stitching;
- manufacturing characteristics; and
- display settings.
Minor variations inherent to textile manufacturing or printing do not necessarily constitute a product defect.
Product colors
We cannot guarantee that colors displayed on your screen precisely represent the colors of the physical product.
Different screens, lighting conditions, garment materials, fabric batches, and printing processes may result in slight differences.
Product sizing
Customers should review the size information available on the relevant Product Page before purchasing.
Measurements may vary within reasonable manufacturing tolerances.
Where a garment has a particular fit, including oversized, relaxed, boxy, slim, or European sizing, we will make reasonable efforts to indicate this on the Product Page.
Nothing in this section affects your statutory rights in relation to faulty, defective, misdescribed, or non-conforming products.
4. ARTWORK AND PRINTING
Bonechoir products may contain original illustrations, graphic designs, typography, photography, symbols, characters, or other artistic elements.
The appearance of printed artwork may vary slightly depending on:
- garment size;
- printing location;
- fabric;
- print technology;
- individual manufacturing tolerances; and
- production facility.
For example, the relative scale or positioning of a design may vary slightly between different garment sizes.
Reasonable production variations are not necessarily defects.
5. MADE-TO-ORDER PRODUCTS
Many Bonechoir apparel products are produced or printed after the customer submits an order.
This production method helps reduce unnecessary inventory and waste.
A product being manufactured or printed after an order is placed does not, by itself, mean that the product is personalized specifically for the customer or that statutory withdrawal rights do not apply.
Where a product is genuinely customized or personalized according to information or specifications provided by the customer, different cancellation or withdrawal rules may apply to the extent permitted by applicable law.
Any such exception will be clearly communicated where relevant.
6. PRICES
Product prices are displayed on the Website in the currency applicable to the customer's selected market or storefront.
Prices may change from time to time.
A price change will not affect an order that we have already accepted, except where permitted by applicable law in cases of an obvious pricing error.
Depending on the customer's location, displayed prices may include or exclude applicable taxes.
Where required by law, applicable VAT or other sales taxes will be included in the price shown before the customer completes the purchase.
Currency conversions performed by Shopify, payment providers, banks, or card issuers may result in small differences between displayed and charged amounts.
Your bank or payment provider may separately charge currency-conversion or international-transaction fees. Bonechoir does not control these fees.
7. IMPORT DUTIES, TAXES, AND CUSTOMS
Orders may be produced or shipped from a country different from the customer's country.
Depending on the destination, an order may therefore be subject to:
- import duties;
- customs charges;
- VAT;
- sales taxes;
- brokerage charges; or
- other governmental fees.
Where such charges are not collected by Bonechoir during checkout, they may be payable by the customer upon import.
Where reasonably possible, we will disclose relevant information concerning duties, taxes, and customs before purchase.
Bonechoir is not responsible for additional charges imposed directly by customs authorities, governments, carriers, or other authorities unless applicable law provides otherwise.
8. ORDERS
When you place an order, you are making an offer to purchase the selected products.
After placing your order, you may receive an automated email confirming that we have received it.
This acknowledgement does not necessarily mean that your order has been accepted.
An order is accepted when we confirm acceptance, begin fulfillment, or otherwise communicate that the order is being processed, depending on the applicable checkout process.
We reserve the right to reject or cancel an order before acceptance for legitimate reasons, including:
- a product being unavailable;
- an obvious pricing or description error;
- suspected fraudulent activity;
- inability to authorize payment;
- delivery restrictions;
- violation of these Terms; or
- circumstances that make fulfillment impossible.
If we cancel an order after payment has been collected, we will refund the applicable amount.
9. ORDER INFORMATION
You are responsible for ensuring that information submitted with your order is accurate, including:
- customer name;
- delivery address;
- billing address;
- email address;
- product;
- color;
- size; and
- quantity.
If you notice an error, contact us as soon as possible at hello@bonechoir.com.
Because some products enter production shortly after an order is placed, we cannot guarantee that changes can be made after fulfillment has begun.
This does not limit any cancellation or withdrawal right granted to you by mandatory consumer law.
10. PAYMENTS
Available payment methods are displayed at checkout and may vary by country.
Payments may be processed by Shopify Payments or other third-party payment processors.
By submitting payment information, you confirm that:
- you are authorized to use the selected payment method; and
- the payment information supplied is accurate.
We do not normally receive or store your complete payment-card details. Payment information is handled by the applicable payment processor according to its own security and privacy practices.
An order may be delayed or cancelled where payment cannot be authorized.
11. PROMOTIONAL CODES AND DISCOUNTS
From time to time, Bonechoir may offer:
- discount codes;
- bundle pricing;
- launch promotions;
- free products;
- free shipping;
- customer-specific offers;
- loyalty rewards; or
- limited-time promotions.
Unless otherwise stated:
- promotions cannot be combined;
- discounts have no cash value;
- discounts cannot normally be applied retrospectively to completed purchases;
- promotions may be limited by product, collection, country, customer, quantity, or date; and
- we may correct or cancel a promotion published as a result of an obvious technical or pricing error.
Specific terms displayed together with a promotion form part of these Terms.
Where we advertise a price reduction, we will comply with applicable consumer-protection and price-display requirements.
12. DROPS AND LIMITED-EDITION PRODUCTS
Bonechoir may release products as part of limited collections or "Drops."
Some Drop products may:
- be available only for a limited period;
- have limited inventory;
- be produced only after orders are received;
- not be restocked;
- have unique fulfillment timelines; or
- have specific purchase limitations.
Any material conditions specific to a Drop will be communicated on the relevant Product Page or Drop Page.
Displaying a product on the Website does not guarantee continued availability.
13. SHIPPING AND FULFILLMENT
Bonechoir may use third-party production and fulfillment partners to manufacture, pack, and ship orders.
As a result, orders may be produced in or shipped from different countries or fulfillment centers.
Orders containing multiple products may occasionally be delivered in more than one shipment.
Production time
Production or fulfillment time occurs before shipping time.
Estimated production times displayed on our Website are estimates unless expressly stated otherwise.
Delivery estimates
Estimated delivery dates or delivery windows are provided in good faith but are not guaranteed unless expressly stated otherwise.
Delivery may be affected by circumstances outside our reasonable control, including:
- customs processing;
- carrier delays;
- severe weather;
- public holidays;
- strikes;
- force majeure events;
- incorrect customer addresses; or
- transport-network disruption.
Where required by applicable consumer law, your statutory delivery rights remain unaffected.
Additional information is available in our Shipping & Delivery Policy on www.bonechoir.com.
14. TRACKING
Where tracking is available, tracking details will normally be provided after an order has been dispatched.
Tracking information is supplied by the relevant carrier and may take time to update.
A tracking status alone does not override any rights the customer may have where an order has genuinely not been delivered.
15. RETURNS, REFUNDS, AND EXCHANGES
Our rules concerning voluntary returns, refunds, exchanges, damaged products, incorrect products, and return shipping are explained in our Returns & Refunds Policy, available on www.bonechoir.com.
The Returns & Refunds Policy forms part of these Terms.
Nothing in that policy or these Terms restricts rights that cannot legally be excluded.
Where a product is faulty, damaged, incorrectly supplied, materially misdescribed, or otherwise non-conforming, customers may have additional statutory remedies depending on their location.
16. EU AND EEA RIGHT OF WITHDRAWAL
If you are a consumer in the European Union or another jurisdiction providing an equivalent statutory withdrawal right, you may have the right to withdraw from an eligible online purchase without giving a reason.
For eligible products purchased by EU consumers, the standard withdrawal period is generally 14 days from the date on which you, or a person designated by you other than the carrier, receives the goods.
Where an order contains multiple goods delivered separately, the relevant withdrawal period may begin when the final eligible item is received, where required by applicable law.
To exercise your right of withdrawal, you must clearly notify us of your decision within the applicable withdrawal period.
Where required, EU customers may use the electronic withdrawal function made available through Bonechoir's Website or customer-account system.
You may also contact us at:
Further information concerning returns and applicable return costs is provided in our Returns & Refunds Policy.
Certain categories of products may legally be excluded from the right of withdrawal, including products genuinely made according to a customer's specifications or clearly personalized for that customer.
Any exclusion will apply only where permitted by applicable law.
Standard Bonechoir designs are not automatically treated as customer-personalized solely because they are printed or manufactured after an order is placed.
This section does not limit any additional consumer rights available under applicable law.
17. UK CONSUMERS
Customers located in the United Kingdom may have statutory cancellation, return, refund, conformity, and other consumer rights under applicable UK consumer law.
Nothing in these Terms is intended to exclude, restrict, or replace any mandatory rights available to UK consumers.
Where these Terms conflict with a mandatory consumer right applicable to a UK customer, the mandatory consumer right prevails.
18. OTHER INTERNATIONAL CUSTOMERS
Customers outside the European Union, EEA, and United Kingdom may have return, refund, warranty, cancellation, or other consumer rights under the laws applicable in their jurisdiction.
Our voluntary return conditions are described in our Returns & Refunds Policy.
Mandatory local consumer rights apply regardless of anything in these Terms that attempts to provide a lower level of protection.
19. DEFECTIVE, DAMAGED, OR INCORRECT PRODUCTS
If you receive a product that is:
- damaged;
- defective;
- materially misprinted;
- materially different from what you ordered; or
- the wrong product,
please contact us at hello@bonechoir.com as soon as reasonably possible.
We may request reasonable evidence, including:
- your order number;
- photographs of the product;
- photographs of the packaging; and
- a description of the issue.
Where a product is defective or otherwise non-conforming, we will provide the remedy required under applicable law, which may include replacement, repair, price reduction, or refund.
We may also voluntarily offer a remedy exceeding the minimum legal requirement at our discretion.
20. INTELLECTUAL PROPERTY
Unless otherwise stated, all intellectual property associated with Bonechoir is owned by or lawfully licensed to VALKYRIE MARKETING SRL.
This includes, without limitation:
- the Bonechoir name;
- logos;
- trademarks;
- illustrations;
- graphic designs;
- artwork;
- characters;
- photographs;
- product imagery;
- videos;
- typography and graphic compositions;
- Website design elements;
- written copy;
- collection concepts;
- Drop names and creative materials; and
- other original content.
Purchasing a Bonechoir product transfers ownership of the physical product only.
It does not grant the purchaser any copyright, trademark right, commercial reproduction right, merchandising right, or license to commercially use artwork appearing on that product.
Without our prior written permission, you may not:
- reproduce our artwork;
- copy our designs;
- sell reproductions;
- create derivative merchandise for commercial sale;
- extract artwork from product images;
- use Bonechoir branding to imply affiliation;
- use our content commercially; or
- otherwise infringe our intellectual-property rights.
Personal, non-commercial use of legally purchased physical products is permitted.
21. USER CONTENT, REVIEWS, AND SOCIAL MEDIA
If you voluntarily submit or publish content relating to Bonechoir, including:
- product reviews;
- photographs;
- videos;
- comments;
- testimonials; or
- social-media posts,
you retain ownership of any rights you hold in that content.
If you directly submit content to us for promotional use or expressly give us permission to repost it, you grant Bonechoir a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share that content for the purposes to which you agreed.
We will not claim ownership of your original content merely because you mention or tag Bonechoir.
You confirm that any content you submit does not unlawfully infringe another person's rights.
22. PROHIBITED USE
You may not use the Website:
- for unlawful purposes;
- to commit or facilitate fraud;
- to distribute malware or malicious code;
- to interfere with Website security;
- to scrape or harvest personal information unlawfully;
- to impersonate another person;
- to infringe intellectual-property rights;
- to submit false or misleading information;
- to attempt unauthorized access to systems or accounts; or
- in any manner prohibited by applicable law.
We may restrict access to the Website where reasonably necessary to prevent misuse or protect our systems, customers, or legal rights.
23. THIRD-PARTY SERVICES
Our Website may rely on or contain links to third-party services relating to:
- Shopify;
- payment processing;
- manufacturing;
- fulfillment;
- delivery;
- analytics;
- advertising;
- social media; and
- customer communications.
Third-party websites and services may operate under their own terms and privacy policies.
Bonechoir is not responsible for independent third-party websites that we do not control.
This clause does not exclude responsibility that applicable consumer law requires Bonechoir to bear for parties used by us to perform our obligations to you.
24. WEBSITE AVAILABILITY
We aim to keep the Website available and functioning properly.
However, we do not guarantee uninterrupted or error-free access.
The Website may occasionally be unavailable because of:
- maintenance;
- software updates;
- hosting interruptions;
- security incidents;
- third-party platform problems; or
- circumstances beyond our reasonable control.
We may modify, suspend, or discontinue Website features where reasonably necessary.
Such changes do not affect rights relating to existing accepted orders unless permitted by applicable law.
25. ERRORS AND INACCURACIES
The Website may occasionally contain typographical errors, technical errors, inaccurate availability information, or incorrect pricing.
Where we identify an obvious error, we may correct it.
If an error materially affects an order that you have already placed, we will contact you where appropriate and provide any remedy required by applicable law.
We will not use this clause to avoid an accepted contractual obligation where doing so would violate mandatory consumer law.
26. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, nothing in these Terms excludes or limits liability for:
- fraud or fraudulent misrepresentation;
- death or personal injury caused by negligence where such liability cannot legally be excluded;
- breach of mandatory consumer rights; or
- any other liability that cannot legally be excluded.
To the maximum extent permitted by law, Bonechoir is not responsible for indirect or consequential commercial losses arising from a consumer purchase where those losses were not reasonably foreseeable at the time the contract was formed.
If you purchase products for business or commercial purposes rather than as a consumer, additional limitations permitted by applicable law may apply.
27. FORCE MAJEURE
We are not responsible for delay or failure to perform an obligation where performance is prevented by circumstances beyond our reasonable control, to the extent permitted by applicable law.
Such circumstances may include:
- natural disasters;
- war;
- civil disorder;
- governmental restrictions;
- widespread transportation disruption;
- epidemic or pandemic events;
- major infrastructure failures;
- strikes;
- customs disruption;
- fire;
- flooding; or
- comparable events.
Where such an event materially affects an existing customer order, we will take reasonable steps to communicate with the customer and provide any remedies required by applicable law.
28. PRIVACY
Our collection and processing of personal information is governed by our Privacy Policy, available on www.bonechoir.com.
Information concerning cookies, analytics, advertising technologies, and consent controls is available in our Cookie Policy.
By using the Website, you acknowledge that personal information may be processed as described in those policies and in accordance with applicable law.
29. ELECTRONIC COMMUNICATIONS
By placing an order, you agree that transactional communications relating to your purchase may be sent electronically.
These may include:
- order confirmations;
- payment notifications;
- shipping updates;
- return communications;
- withdrawal confirmations;
- customer-service correspondence; and
- legally required notices.
Transactional communications are separate from marketing communications.
We will send promotional marketing only where we have an appropriate lawful basis and, where required, consent has been obtained.
You may unsubscribe from marketing communications at any time using the unsubscribe mechanism provided.
30. GOVERNING LAW
These Terms and contracts concluded through the Website are governed by the laws of Romania, except where mandatory consumer-protection law requires otherwise.
If you are a consumer, this choice of law does not deprive you of any mandatory protection granted to you under the laws that would otherwise apply in your country of residence.
31. DISPUTES
If you have a complaint or dispute relating to an order, we encourage you to contact us first at:
We will make reasonable efforts to resolve the matter directly.
Nothing in these Terms prevents a consumer from exercising any right to bring a claim before a competent court or use an alternative dispute-resolution mechanism available under applicable law.
Any jurisdiction clause in these Terms applies only to the extent permitted by mandatory consumer law.
32. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally possible.
The remaining provisions will continue in effect.
33. NO WAIVER
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
Any waiver applies only where expressly given and only to the particular circumstances concerned.
34. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect:
- changes to our business;
- changes to Website functionality;
- new products or services;
- changes to payment or fulfillment arrangements;
- legal or regulatory requirements; or
- other legitimate operational reasons.
The version published on the Website will state the date of the most recent update.
Changes will not retroactively reduce mandatory rights relating to orders concluded before the updated Terms took effect.
